Application for Consent to Posthumous Donation

This is an intravital consent to the removal of anatomical materials from the human body for transplantation or the manufacture of bio-implants. This becomes possible only after the person who submitted the application is declared irretrievably dead (brain death or biological death).

In accordance with Article 16 of the Law of Ukraine “On the Application of Transplantation of Anatomical Materials to Humans”, an application for consent to posthumous donation can be submitted in writing by any person of full legal capacity.

To submit an application for posthumous donation consent,

уou should contact the transplant coordinator of any health care institution that has access to the Unified State Information System for Transplantation (USIST), transplant centers, or the specialized state institution “Ukrainian Center for Transplant Coordination”.

At the specified time, you should arrive at the health care facility and write an application in your own hand according to the model approved by Resolution of the Cabinet of Ministers of Ukraine No. 1211, dated December 27, 2018.

Which center can be contacted?

To submit an application, one should contact the transplant coordinator of the nearest transplantation center or the specialized state institution “Ukrainian Center for Transplant Coordination.”

If a person lives in a region where there are no transplantation centers, they can contact any other transplantation center at a convenient address.

Who sees the application?

The application for posthumous donation is confidential information, and its processing is carried out in compliance with the requirements of the Constitution of Ukraine and the laws of Ukraine “On the Protection of Personal Data” and “On Information.”

Only the transplant coordinator of the healthcare institution to whom the application was submitted, and the transplant coordinator of the transplantation support department of the State Institution “Ukrainian Center for Transplant Coordination” can see the consent or objection to posthumous donation or applications for their revocation in the USIST system.

Application for Objection to Posthumous Donation

This is a written objection to the removal of anatomical materials from the body of a person for transplantation or the manufacture of bio-implants in the event of the applicant’s irreversible death (brain death or biological death). Any person of full legal capacity may submit a written application for objection to posthumous donation during his lifetime. The sample application was approved by Resolution of the Cabinet of Ministers of Ukraine No. 1211 dated December 27, 2018.

Is it possible to withdraw consent or dissent for posthumous donation?

A person has the right to withdraw such statements. To do this, they must again contact the transplant coordinator with an identity document and write an application to revoke previously given consent or dissent for the removal of anatomical materials for transplantation. The sample application for revoking previously given consent or dissent for posthumous donation is approved by the Resolution of the Cabinet of Ministers of Ukraine No. 1211 dated December 27, 2018.

The number of applications that an individual can submit during their lifetime regarding consent or dissent for posthumous donation is not limited.

Each subsequent written application regarding consent or objection to posthumous donation or written application for revocation of previously given written consent or objection for posthumous donation cancels the previously given application. That is, only the last submitted application, which was entered into the USIST, is considered.

They verify and obtain consents for donation, update the Unified State Information System for Transplantation (USIST) data, organize the prompt and safe transportation of organs, etc. A transplant coordinator, who has received a written consent to posthumous donation, enters it into the USIST within 24 hours. The transplant coordinator cannot be part of the council of doctors that determines brain death, nor can they participate in the removal of anatomical material and the transplantation process.

No, it is not possible. According to Article 20 of the Law of Ukraine “On the Application of Human Anatomical Material Transplantation,” any agreements for the sale of human anatomical materials in Ukraine are prohibited.
